Default on payday loan in Texas?

If you default on a payday loan, because something happened and you are unable to pay. Could I be charged with bad checks, when I didn't actually write a check for the payday loan. Charge by DA for bad check?

Reply:No, for the default to be of a criminal nature the state would have to prove intent.


Unforeseen circumstances that adversely affect your payment plan are just that and do not constitute fraud.


The missed payment could end up on your credit history though so I suggest you contact the lender and make arrangements prior to the due date.

The predatory lending of Payday lo0ans company's (400 - 800% a year interest) cause more hardships than drugs in Texas.


Yes you can be charged for a bad check by the DA.


Thery are not in the pocket of the loan companys but the loan laws are so they WIN.
